How to Check Zoning Status Before Buying Land

A land parcel's real investment value comes down to what can be built on it, and that's determined by its zoning status. A parcel with an attractive price may not offer what you expect once you check the zoning, which is why zoning verification should sit at the center of any land purchase decision.

What Is a Zoning Status Document, and Where Do You Get It?

A zoning status document is an official record showing what purpose (residential, commercial, industrial, agricultural, etc.) and what density a parcel is zoned for. It can be requested from a municipality's zoning and urban planning directorate with a petition and title deed information; many municipalities also offer partial access to this information through their website or e-Municipality app.

What Do TAKS and KAKS Mean?

The two abbreviations you'll most often see on a zoning status document are TAKS (base area ratio) and KAKS/Emsal (floor area ratio). TAKS shows how much of the parcel can be covered by a building's footprint; KAKS shows the total construction area allowed on the parcel. Together, these two figures are the key to understanding a parcel's real building potential.

The Difference Between Residential, Commercial and Industrial Zoning

  • Residentially zoned land: Allows building exclusively, or predominantly, for residential use
  • Commercially zoned land: Allows commercial use such as shops, offices or business centers
  • Industrially zoned land: Allows production-oriented construction such as factories, warehouses or workshops
  • Farmland: Generally closed to construction; converting it to non-agricultural use requires a separate approval process

What If the Zoning Plan Isn't Finalized Yet?

In some areas, particularly those undergoing reconstruction, the zoning plan may not yet be finalized. In that case a parcel can carry a 'zoning pending' status; this can represent an opportunity, but it also carries uncertainty. When evaluating such a parcel, it's important to carefully research what stage the plan is at and how likely it is to be finalized.

What to Look for in a Zoning Status Certificate

  • That the block and parcel number match the title deed exactly
  • The plan function: residential, commercial, industrial, agricultural, green space and so on
  • TAKS, KAKS and the maximum permitted height or number of floors
  • Street frontage, setback distances and any plan notes
  • The issue date; if the zoning plan has changed, an older certificate may no longer be valid

A Practical Pre-Purchase Checklist

  • Ask the municipality for a recently dated zoning status certificate
  • Check the title deed for mortgages, liens and annotations
  • Verify on site that the parcel's actual situation (road, neighboring parcels, slope) matches the certificate
  • Ask whether public restrictions such as expropriation, road widening or green space apply
  • If the title is shared, clarify the position of the other co-owners

Common Mistakes

The most common mistakes are relying on an outdated zoning certificate, comparing price by square meter alone and settling for a verbal assurance. Two parcels at the same price can have very different TAKS and KAKS values, so a price advantage often stays only apparent unless it is weighed together with the zoning conditions.

Conclusion

Checking zoning status is the most critical step in a land investment. Skipping this check carries the risk of running into unexpected restrictions later. As part of our consulting process, we look up and report the current zoning status of any parcel you're interested in.
